Regulatory framework

The Brazilian General Telecommunications Law, No. 9,472/1997 (Lei Geral de Telecomunicações) establishes the general requirements for the use of satellites and for the provision of satellite supported services. The use of satellites involves national rules, established by Anatel, and international rules, established by the International Telecommunications Union (ITU).
The Table of Frequency Allocations in Brazil (Plano de Atribuição, Destinação e Distribuição de Frequências no Brasil - PDFF) establishes the regulatory framework for the use of the radio spectrum in Brazil. Satellites can only be used in frequency bands allocated to satellite services and destinated to compatible Brazilian telecommunications services.
The most important regulatory instruments applicable to satellite use in Brazil are:
- General Regulation on Satellite Exploration - Resolução nº 748/2021;
- Private Limited Service - Resolution nº 617/2013;
- Radio Spectrum Use Regulation - Resolução nº 671/2016;
- Amateur Service Regulation - Resolução nº 449/2006;
- Technical and Operational Requirements for Satellite Communications Systems - Ato nº 9523/2021;
- Technical and Operational Requirements for Coexistence between stations operating in C Band - Ato nº 9426/2021;
- Satellite exploration commitments and public consultation criterias for granting a satellite exploitation rights - Ato nº 4430/2023.
- Global Mobile Satellite Service Regulation - Norma nº 16/1997;
