NEW BRAZILIAN LEGISLATION FOR SWORN TRANSLATOR AND PUBLIC INTERPRETER - 07/11/2022
The Embassy of Brazil in Zagreb informs that came into force the Law 14.195, of 26, August, 2021, which restructured the profession of sworn translator and public interpreter in Brazil.
The new legislation, even though it maintains the possibility of accessing vacancies through a specific public examination, created the possibility for the contest to be waived for those who obtain a degree of excellence in National and International Proficiency Exams, according to the regulation of the DREI - Normative Instruction DREI/ME No. 52/2022.
The aforementioned Normative Instruction 52/2022, already regulated by the subsequent Normative Instruction 74/2022, specifies that the degree of excellence in National or International Proficiency Exams, in order to prove the professional's aptitude, must be verified by the Commercial Boards upon presentation of certification issued at Level C2, according to the scale defined in the Common European Framework of Reference for Languages (CEFR) - Common European Framework of Reference for Languages, or certification that attests to a level of proficiency equivalent to the scale adopted by the CEFR, when the assessment takes place through another referential.
The new regulation also allows professionals to work throughout the Brazilian territory, and no longer only in the State of the Federation of your enrollment - as was determined by the revoked legislation. Minimum age requirements and proof of domicile where the profession will be exercised were also excluded. The measure also allows foreign professionals residing in Brazil to work as official translators while the annulled regulation reserved the vacancies to Brazilian nationals only. The normative instruction also eliminated the remunerative fee table established by the Commercial Board.
Finally, we inform you that the Business Registration Department and Integration is in the process of holding the 1st national public examination to assess the adequacy of the candidates for the exercise of profession of Translator and Public Interpreter.
