LETTER OF NO OBJECTION / "J-1 VISA WAIVER - NO OBJECTION STATEMENT"

 Requests for letters of no-objection (LNO)

Requests for letters of no objection from the Brazilian government for visa changes in the U.S., pursuant to Section 212(e) of the U.S. Immigration and Nationality Act, should be sent to the Education Section of the Embassy of Brazil in Washington, D.C., at waiver.washington@itamaraty.gov.br, following the procedures outlined below:

Step 1:

Applications for waivers of the two-year residency requirement must be submitted directly to the Department of State. For more information, visit the Department of State website.

Step 2:

After receiving the case number from the Department of State, the interested party may request, from the Education Section of the Brazilian Embassy in Washington, D.C., the Letter of Non-Objection from the Brazilian Government for Visa Change in the United States.

Step 3:

If all of the requirements listed below are met, the Embassy of Brazil in Washington will send the Letter of No-objection directly to the Department of State and notify the applicant by e-mail that the letter has been sent. It will then be up to the applicant to follow the waiver application process at https://j1visawaiverrecommendation.state.gov (see "Check Status" section). For questions regarding your application, please contact the Department of State at 212ewaiver@state.gov.

ATTENTION: Please do not send the documents listed below to waiver.washington@itamaraty.gov.br until you have received the case number issued by the Department of State and, if applicable, the letter of no objection from the Brazilian funding agency(s). Incomplete applications will not be processed.

Required documents:

Please send ONLY the applicant's documents listed below in PDF format as attachments. Links to file-sharing sites will not be opened. Documents from family members are not necessary.

1. Application form for Letter of No Objection from the Brazilian Government for Visa Change in the United States, duly completed and signed by the applicant (updated 12/23/2021).

2. A copy of the waiver file with the Department of State (Third Party Barcode Page).

3. Copies of all DS-2019 (US Department of State Certificate of Eligibility for Exchange Visitor J-1 Status) forms received to date.

4. Copies of current passport identification page and U.S. visa page(s) received to date. If the applicant is a Brazilian resident and the last country of residence before coming to the United States was Brazil, this information must be indicated on the form (field #9) and a copy of the corresponding RNE (National Foreigner Registration) must be attached to the file.

5. When applicable, a letter from the Brazilian institution(s) that funded the applicant's studies in the United States, stating that there is no objection from the agency to the applicant's uninterrupted stay in the United States and to the visa change. Brazilian public servants must observe the relevant legislation regarding the possibility of absence from the country.

NOTES:

- The Embassy of Brazil in Washington provides this service free of charge. There is no need for the applicant to hire lawyers, agencies or brokers to gather and submit the above documents.

- The documents listed above may be submitted in either Portuguese or English. There is no need for translation, legalization or notarization.

Processing time:

Upon receipt of all required documents, the Embassy of Brazil in Washington will endeavor to review the application within approximately fifteen working days.

EDUCATIONAL COOPERATION

Educational cooperation initiatives with the United States are developed by the Brazilian Federal Agency for the Support and Evaluation of Graduate Education (CAPES). The first round of the Institutional Internationalization Program (or PrInt, acronym in Portuguese) developed by CAPES is currently being implemented.

Institutional Internationalization Program (PRINT)

Objectives: Encourage the construction, implementation and consolidation of strategic internationalization plans for the covered institutions in their prioritized areas of knowledge; encourage the formation of international research networks to improve the quality of academic production related to postgraduate studies; expand actions to support the internationalization of postgraduate studies in the covered institutions; promote the mobility of faculty and students, with an emphasis on doctoral students, post-doctoral students and faculty abroad and from abroad to Brazil, linked to postgraduate programs with international cooperation in the strict sense; promote the transformation of the participating institutions into an international environment and integrate other CAPES support actions into the internationalization effort.

Duration of projects: up to four years
