VITEM IX - INVESTMENT
ATTENTION: According to current Brazilian legislation, the granting of an Investor Visa depends on prior residence authorization in Brazil, which must be processed before the Ministry of Justice and Public Security. As a general rule, the application for a residence permit is initiated, in the "MigranteWeb" System, by the interested party. In the following link, you can find all the information necessary to process your residence application: https://portaldeimigracao.mj.gov.br/pt/. Only after the residence application is approved by the Ministry of Justice in Brazil, the foreign investor must contact the Consular Section to process the issuance of his visa.
There are three clusters of activities that might grant the Investor Temporary Visa - VITEM IX:
- According to the Normative Resolution nº 11/2017 of the National Immigration Council (CNIg), an Investment Visa may be issued to managers, directors or executives with managerial powers to represent civil or commercial societies, groups or economic conglomerates that carry out external investment in a company established in Brazil, with the potential to generate jobs or income.
- Additionally, CNIg Normative Resolution nº 13/2017 states that residency permits may be granted to natural persons who intends, with their own resources of external origin, to invest in a legal entity in Brazil, in a project with potential for employment or income generation in Brazil.
- A third possibility was presented by the CNIg Normative Reolution n° 36/2018 that regulates the granting of a residence permit as a result of real estate investment in Brazil.
Visa applications for a VITEM IX should be presented only after confirmation from the Embassy that the clearance has been received.
