Power of Attorney
General Info
Brazilian nationals and foreigners holding a valid RNM/RNE card (Carteira de Registro Nacional Migratório / Registro Nacional de Estrangeiros) are elegible to apply for a public power of attorney (in Portuguese) drawn at the Embassy, to be used in Brazil (see below). For documents to be used in third countries, applicants must seek information from the embassies or consulates of the destination country.
Other foreigners (including spouses of Brazilians) must issue a private power of attorney, sign it before a Singapore Notary Public and submit the document, with the Notary Certificate attached, for legalization by the Singapore Academy of Law. The document must then be translated, in Brazil, by an official Sworn Public Translator ("tradutor público juramentado"). There are no steps no be taken at the Embassy in this case.
Both parties in the Power of Attorney (grantors and agents) must be properly identified at least by name and ID/passport number, even if the grantor is signing on behalf of a company. Most applications of a Power of Attorney in Brazil will also require the identification of date and place of birth, nationality, address and marital status of the agent(s).
Required Documents and Procedures
- Filled-out Application Form;
- Original applicant's passport and RNM/RNE card;
- Married grantors must also present the marriage certificate;
- To guarantee the security of the act, very old identity documents with a discrepancy between the photo at the time and the person in the present will not be accepted..
- In powers of attorney in which the grantor is a legal entity, the managing partner must present, in addition to documents proving their identity as above, the following documents: entity's CNPJ, most recent Articles of Incorporation ("Contrato Social") and Simplified Certificate of the Board of Trade ("Certidão Simplificada da Junta Comercial", valid for 30 days).
Fees and Processing Time
- Public power of attorney: S$ 30.00
- for powers of attorney with more than one grantor, the above fees will be charged per grantor, unless in case of spouses, siblings and heirs, for inventory and inheritance purposes;
- re-issuances: S$ 15.00;
- for collection of pension payment or salary/retirement payment from a Government agency: S$ 7.50.
- Payment must be made through one of the following options:
- PayNow transfer to PayNow ID (UEN) S68DP0048C or by scanning the QR code below;
- FAST transfer or cash deposit at United Overseas Bank (UOB), account number: 339332338-6 - Embassy of Brazil;
- Please input applicant's name or application number in the "reference" or "comment" field when using PayNow or FAST transfers.
- PayNow transfer to PayNow ID (UEN) S68DP0048C or by scanning the QR code below;
- Applications are processed and the document is issued on the spot.
- Please note that processing time may be extended in times of heavy workload or due to unforeseen circumstances.
Remarks
- The revocation of mandate (power of attorney) can be done in one of the following ways:
- if the power of attorney has been drawn up at the Embassy:
- grantor and the grantee must be presented to sign a revoking term;
- the grantor shall request the competent judicial authority of the grantee's place of residence that both the grantee and the Brazilian Consular Office where the mandate was drawn up be notified of the desire to revoke it;
- the grantor will present a statement from the grantee, with a notarized signature and, if applicable, from third parties who have dealt with the removed attorney, for the drafting of a revoking term.
- if drawn up in a Notary's Office in Brazil:
- The grantor will request the judge of the grantee's place of residence that both the grantee and the Notary where the mandate was drawn up be notified of the desire to revoke it.
- Term of validity of a power of attorney:
- with the exception of powers of attorney whose validity period is determined by law, such as for marriages (in which the period is 90 days), in general the powers of attorney are valid for an indefinite period, unless its validity period is explicitily stated by the grantor;
- this means that the powers you transmit remain in effect for the indicated validity period or indefinitely, until the power of attorney is revoked! It is therefore recommended to determine the expiration date.
