VITEM V - Work
Work visas are subject to prior approval by the Brazilian Ministry of Justice and Public Security. This means that the sponsoring company (on behalf of the applicant) must initiate the process in Brazil by submitting the appropriate application and supporting documentation to this Ministry.
Once the process is completed and approved in Brazil, the Ministry of Justice and Public Security, through the Brazilian Ministry of Foreign Affairs, will forward the authorization to the Consular Section of the Embassy. Only then will the applicant be able to proceed and submit the visa application itself to the Consular Section by submitting the documents listed below.
Please note the difference between the work permit for Brazil - issued by the Brazilian Ministry of Justice and Public Security (MJSP) - and the authorization to issue a visa by the Brazilian Ministry of Foreign Affairs. Since the issuance of a work visa depends on the work permit and its approval by the competent authority in Brazil, the applicant should not submit his/her application documents to the visa section immediately after being notified that the work permit has been issued. Rather, he/she should allow for a waiting period of a few days after the work permit has been approved, as the internal transmission between the ministries and the embassy always takes a few days. If there is any doubt as to whether the visa section has already received ministerial approval to issue the visa, the applicant may contact the visa section by e-mail to verify this information.
Foreigners already in Brazil can apply directly to the Brazilian Ministry of Justice and Public Security for a work permit (there is no need to return to Germany to obtain a VITEM V).
Length of stay in Brazil
- Validity period (deadline for the first entry in Brazil): up to 1 year
- Duration of stay (period during which the individual is allowed to remain in Brazil): up to 2 year, according to authorization by the Ministry of Justice
- Extension of stay: extension subject to approval by the Brazilian Ministry of Justice and National Security.
Important General Information:
This type of visa can only be issued to foreign professionals whose qualifications and/or experience are compatible with the activities to be performed in Brazil, under the following conditions:
- With employment relationship, under an employment contract / agreement (based on Normative Resolution 02/2017
- Without employment relationship, by virtue of contract or agreement with the company, to provide technical assistance services to a company based in Brazil (based on Normative Resolution 03/2017)
- ;
- Without employment relationship, to work on board cruise vessels in the Brazilian coast, with length of stay larger than 90 days;
- Without employment relationship, to conduct maritime worker activities aboard vessels or platforms operating in Brazilian jurisdictional waters (based on Normative Resolutions 05/2017 , 06/2017 and 22/2017);
- Without employment relationship, for the provision of services / assistance to the Brazilian Government (based on Normative Resolution 07/2017);
- Without employment relationship, in order to represent a foreign financial institution (based on Normative Resolution 09/2017);
- Without employment relationship, in order to represent a non-profit corporate legal entity (based on Normative Resolution 10/2017);
- Without employment relationship, by virtue of specific Brazilian federal legislation (based on Normative Resolution 12/2017);
- Without employment relationship, for the purposes of training, exchange of experience and assimilation of the corporate culture and management style of a transnational economic group with headquarters in Brazil (based on Normative Resolution 18/2017);
- Without employment relationship, for training purposes within company of the same group (based on Normative Resolution 19/2017);
- Without employment relationship in Brazil, to work on board fishing vessels operating in Brazilian jurisdictional waters;

The photo must be recent (not older than six months), on a white background, in the local standard size (3.5 x 4.5 cm). The photo must be affixed on the Visa application form. |

Certificate of Conduct of the Federal Office for Justice |
Certificate of Conduct issued by the Federal Office of Justice. Certificates of conduct are valid for up to 3 months from the date of issuance. If the applicant has lived in more than one country within the last 12 months, a Certificate of Conduct from each country of residence must be submitted. If the document was issued in a country other than Germany, the Hague Apostille must be affixed to the document. In countries where The Hague Apostille is not required, the document must be legalized by a Brazilian consulate or embassy. |

Residence Certificate (Erweiterte Meldebescheinigung) |
The addresses and move-in dates for the last 12 months must be on the certificate. |

Original full birth certificate* |
If German, present a copy of your birth certificate. If the document was issued in a country other than Germany, it must have the Hague Apostille. In the countries where the Hague Apostille is not applicable, the document must be legalized by a Brazilian consulate / embassy. Note: The purpose of submitting this document is to avoid discrepancies between the information contained in the visa application and the birth certificate itself. Since the birth certificate must be presented during the mandatory registration of the visa with the Federal Police in Brazil (see below), any discrepancy will prevent the completion of this process. Therefore, the presentation of the birth certificate during the visa application phase abroad is not mandatory and will not prevent the visa from being issued, but it is highly recommended in order to avoid possible inconveniences. |
Registration with the Federal Police
VITEM V holders must register with the Federal Police within 90 days of first entry into Brazil. Contact the Federal Police directly to find out how to register.
The Consular Sector anticipates that the applicant will be required to present to the Federal Police, among other documents, the Visa Application Form (FPV) provided at the time of visa issuance, as well as the original full birth certificate with the full names of the parents.
Documents issued in Germany can be apostilled by various authorities (check here) If the document is legalized, it must be translated into Portuguese by a sworn translator ("tradutor juramentado") in Brazil.
