Humanitarian visa for Afghans
"It was published in the Official Gazette of the Union (Diário Oficial da União), on 26/09/2023, the Interministerial Ordinance MJSP / MRE No. 42, of September 22, 2023, which provides for the new rules for the granting of temporary visa and residence permit for humanitarian refuge purposes for Afghan nationals, stateless persons and persons affected by the situation of serious or imminent institutional instability, of serious violations of human rights or humanitarian law in Afghanistan in the context of the events of August 2021.
2. The new measure, which will come into force on 02/10/2023, repeals the Interministerial Ordinance MJSP/MRE No. 24 of September 3, 2021. The main elements brought by Ordinance No. 42 are:
i. The temporary humanitarian reception visa (VITEM III) may be granted to Afghans, stateless persons and persons directly affected by the events of 15 August 2021, thus excluding applicants who have left Afghanistan before that date.
ii. Only the Posts in Islamabad and Tehran are authorized to grant VITEM III in question.
In this context, until 01/10/2023, applications for VITEM III applications by nationals of Afghanistan will be subject to the rules of the MJSP/MRE Interministerial Ordinance No. 24 of September 3, 2021. As of 02/10/2023, only requests that meet the requirements of Ordinance No. 42 will be processed, in addition to the processing of interviews conducted until 01/10/2023, under the rules of Ordinance No. 24."
