RETIREMENT - INTERNATIONAL SOCIAL SECURITY AGREEMENT BETWEEN BRAZIL AND THE UNITED STATES
Brazilian and / or American workers who are subject to the rules of the International Social Security Agreement between Brazil and the United States are those who are or have been subject to the legislation of one or both contracting countries and those who have derived rights regardless of their nationality.
The Brazilian who lives in the United States can total the contribution periods in both countries to be entitled to the benefits provided for in the agreement: retirement by age, pension by death and retirement by disability. The application may be submitted to the American social security institution, and there is no need to come to Brazil or appoint a proxy to make the request.
The North American resident in Brazil will be able to total the contribution periods in both countries in order to be entitled to the benefits provided for in the agreement, having to make the request in the INSS.
Policyholders who are affiliated, in Brazil, to the Social Security System for Public Servants and the Military System can use periods of contribution to the North American social security system to implement the right to benefit. The request must be made at the management unit of the agency to which the public servant belongs.
It is important to emphasize that the country of residence is not necessarily a requirement for counting contributions, but rather the regime to which the worker is subject. The person who is duly contributing to Social Security in any of the agreeing countries may use the agreement to acquire the right to the benefits provided, regardless of their nationality.
Those residing in Brazil can apply for the benefit at Social Security Agencies, after previous scheduling.
