Registration of marriages of Brazilian nationals celebrated in Türkiye
GENERAL INFORMATION
1 - The marriage of a Brazilian citizen in Turkey must be registered with the Consulate in order to produce legal effects before the Brazilian consular authorities abroad.
2 - In order to produce full legal effects in Brazil, the marriage certificate issued by the Consulate must be transferred by the person concerned to a notary's office in Brazil, at any time when they have the opportunity to go to Brazil in person, or by a third party, depending on the notary's office.
3 - The marriage can only be registered at one Brazilian consulate.
We recommend using a mobile phone or computer with a scanner to fill in the following forms, as you will need to send images (or photos) of documents.
Photos or documents scanned by mobile phone should be clear, only the document should appear, do not photograph other objects.
REQUIRED DOCUMENTATION
1 - Original and copy of the Turkish marriage certificate (Evilik Cüzdanı). The document must be presented in its entirety. If the certificate was issued in a country other than Turkey, it must be apostilled or consularised at a Brazilian consulate in the country of origin, if that country is not a member of the Apostille Convention. In these cases, the marriage certificate must also be translated into English or Portuguese by a public translator.
2 - Original and copy of the prenuptial agreement (if there is one). A prenuptial agreement made in Turkey, if there is one, must be presented. The pact must be apostilled by the Turkish apostille authority and translated into Portuguese by a public translator.
3 - Original and a copy of the Brazilian spouse's documents (if both spouses are Brazilian, it is mandatory to present both documents).
One of the following documents will be accepted:
- Brazilian passport; or
- Brazilian identity card (RG); or
- National driving licence (with photo); or
- Professional identity card.
You must also present one of the following documents, which will depend on your marital status before the wedding:
a) If single: a Brazilian birth certificate issued less than six months ago;
b) If divorced: a Brazilian marriage certificate issued less than six months ago with a divorce annotation;
c) If widowed: a Brazilian marriage certificate with the death annotation of the former spouse, issued less than six months previously.
The presentation of one of these certificates with a recent date is a legal requirement for proof of marital status in Brazil.
4 - Original and copy of the foreign spouse's documents.
The following documents must be presented:
a) Valid passport or Kimlik;
b) Birth certificate or equivalent;
c) Declaration that you have never been married to a Brazilian national. The declaration is not required if the marriage certificate states that the spouse's marital status at the time of the marriage was "single". In all other cases, or if the certificate does not mention the marital status of the foreign spouse at the time of the marriage, it is necessary to present the declaration, which must be signed at the Consulate. If the foreigner cannot be present to sign in front of the consular officer, the signature must be notarised and apostilled by the Turkish apostille authority.
If divorced, you must also present:
- Official divorce document if the ex-spouse is a foreigner; or
- Brazilian marriage certificate with divorce annotation; or original of the homologation decision if the ex-spouse is Brazilian.
If widowed, the death record of the former spouse must also be presented.
If any of the certificates were issued outside Turkey, they must be apostilled or consularised at a Brazilian consulate in the country of origin. If that country is not a member of the Apostille Convention, the certificates must also be translated into English or Portuguese by a public translator.
