VITEM XII – Artistic or Sport Activity Under Contract
In order to apply for a VITEM XII, it’s required to start the process in Brazil. The Brazilian contractor must file a petition for temporary residency authorization at the Ministry of Justice in Brazil (“Ministério da Justiça”). Only after the authorization is granted, the applicant will be able to apply for a visa at the Consulate General of Brazil in Los Angeles.
The only exception that NOT requires to start the process in Brazil is for Amateur athlete over 14 and under 18 years old.
ELIGIBILITY:
1) Professional in artistic fields (musician,artist, fashion model and their assistants/crew members/supporting technical staff) going to stay over 90 days without an employment contract in Brazil.
2) Professional in sport fields (athlete, coach and their assistants/crew members/supporting technical staff) going to stay over 90 days without an employment contract in Brazil.
* If the Artists or athletes are participating in events shorter than 90 days, they may apply for a Visitor Visa (VIVIS).
* If the professional athlete is contracted by a Brazilian sport-related company to perform sport activities, holding an employment contract with a duly registered athletic entity, may apply for Work Visa (VITEM V).
3) Amateur athlete over 14 and under 18 years old for sports training purpose going to stay up to 1 year.
4) Amateur athlete over 14 and under 18 years old for sports training purpose, during his/her school break/vacation, going to stay up to 90 days.
GENERAL REQUIREMENTS:
1) PASSPORT: Signed, valid up to the end of your trip and with at least one visa blank page available (amendment pages are not accepted).
2) VISA APPLICATION FORM: One per applicant, completely filled out online and signed by the passport holder or his/her parents/guardians. You will need to print only the receipt page with the bar code.
3) PHOTO: One recent 2” x 2” passport-photo size, front view, white background.
4) BACKGROUND CHECK: FBI Clearance or Local Police Department Clearance issued within the last six months.
5) BIRTH CERTIFICATE: copy of your birth certificate.
NOTE: Once in Brazil, you must present at Federal Police the birth certificate authenticated by an Apostille. It should be also translated by a certified translator in Brazil (“tradutor juramentado”).
ADDITIONAL REQUIREMENTS (if applicable):
1) ELIGIBILITY ON ITEM 3: Amateur athlete over 14 and under 18 years old:
1.1) Document proving the Brazilian organization has been registered in sport association or sport league.
1.2) Document proving the Brazilian organization has been registered in Training Program at the Municipal Council for the Rights of Children and Adolescents (“Conselho Municipal dos Direitos da Criança e do Adolescente”).
1.3) Declaration of responsibility for the maintenance and subsistence of the athlete in Brazil, assuring:
- Maintenance of the athlete during his/her stay in Brazil and assurance of his/her repatriation once the visa expires.
- Medical, dental and hospital coverage.
- Enrollment at an educational institution, as well as supervision of his/her attendance.
- Promotion of the right to family and community cohabitation of the adolescent.
- Guarantee of the applicant’s rights as stipulated under Brazilian legislation, in particular, Children and Adolescent Statute (“Estatuto da Criança e do Adolescente”).
1.4) Term of agreement of the Brazilian organization with an educational institution or demonstration of its
own educational structure.
2) ELIGIBILITY ON ITEM 4: Amateur athlete over 14 and under 18 years old during his/her school break/vacation:
2.1) Declaration of responsibility for the maintenance and subsistence of the athlete in Brazil, assuring:
- Maintenance of the athlete during his/her stay in Brazil and assurance of his/her repatriation once the visa expires.
- Medical, dental and hospital coverage.
- Guarantee of the applicant’s rights as stipulated under Brazilian legislation, in particular, Children and Adolescent Statute (“Estatuto da Criança e Adolescente”).
2.2) US/Foreign school statement assuring that the immigrant athlete will participate in sport training
program in Brazil during his/her school break/vacation.
3) FOREIGN RESIDENTS: Copy of the US Alien Resident Card and/or a Valid Visa.
4) MINORS:
- Visa Request Form Receipt – RER must be signed by both parents or legal guardians;
- Original or notarized copy or birth certificate;
- Copy of parents' passports; and
