In order to request prioritized examination, it is necessary to follow these steps:

Before the request |
To request the prioritized examination, it is necessary to already have a regularly filed patent application. For help with the application, check out the Basic guide for patents at our website. At the time of the application, the applicant or his/her legal representative shall receive the number of the patent proceeding to be used in the following step. The proceeding shall be published (or be able to be published) and the request for a substantive examination shall be paid. |
Issue the GRU |
The first step of the request is issuing the Federal Government Payment Form (GRU). Issuing the GRU is mandatory even if the service is free of charge. The Type of Service is Patent of Invention and Utility Model. The Service and Object of the Petition shall be chosen according to the intended type. Finally, the number of the patent application received in the filing shall be informed in the administrative proceeding. When confirming the service, the applicant shall receive the GRU number to be used in the following step. |
Pay the GRU |
The amount for the service shall be paid. |
Complete the electronic form |
The second step is completing the form for requesting a prioritized examination at https://gru.inpi.gov.br/peticionamentoeletronico/ (requesting the prioritized examination on paper copy is not allowed anymore). The proceeding begins by entering the GRU number (generated in the previous step). Check the Interested Party Data and click on Edit to add or change it. If there are more interested parties, enter them using the Add Interested Party button. The mandatory documents described in the resolution regulating the topic shall be attached thereto. It is necessary to state that the information is true. At the end of the proceeding, the request for prioritized examination is filed. |
Follow-up |
INPI shall assess the requests based on the specific Resolution for prioritized examination and on DIRPA Normative Ruling No. 2/2020. The answer shall be published in Industrial Property Journal (RPI) in Section VI – Patents, with the series 28 order codes. |
