ICT Patents
The Pilot Project ICT Patents is a type of priority examination. The patent applications filed by Science and Technology Institutions (ICT) are capable of participating, pursuant to the definition in item V of article 2 of Law No. 13,243 of January 11, 2016.
The Project has two purposes. The first one is the stimulation and facilitation of the inclusion of innovative goods and services in the market developed by the ICTs. The second one is related to the mitigation of the negative effects of INPI’s delay in the decision of patent applications for this specific niche of applicants.
Stage I of the Project was governed by INPI/PR Resolution No. 191 of May 18, 2017, published in RPI No. 2420 of May 23, 2017, and ended on May 31, 2018.
Stage II of the Project was governed by INPI/PR Resolution No. 220 of May 25, 2018, published in RPI No. 2473 of May 29, 2018.
Stage III was governed by INPI/PR Resolution No. 238 of May 25, 2019.The main characteristics of this new stage are:
1. Beginning on June 1, 2019, with effectiveness of 1 year or up to 100 participation requests – whichever occurs first.
2. Proceeding requirements:
3. Belonging to an ICT;
4. Being published or being likely to be published; and
5. Having the examination request paid off (in addition to the priority request);
6. Request Requirements:
7. Submitted by the applicant ICTs;
8. A single request per month;
9. Payment of the fee (service code 279);
10. Submitted through electronic form;
11. Proof of classification as ICT;
12. Submit between June 1, 2019, and May 31, 2020.
