With Patent Prosecution Highway (PPH), after a partner patent institute considers the matter of a patent application as patentable, it is then possible to give priority to the patent application for the same invention and owner in INPI.
The PPH, by using all information related to the research or examination of the Office of Earlier Examination (OEE), helps the applicants in their efforts to obtain patent rights with more legal certainty and more efficiently in several countries. Additionally, the project intends to optimize the examination of the main patent offices in the world.
The individualized PPH pilot projects were finished on November 30, 2019, and, as of December 1, 2019, a new pilot project was initiated with standard requirements. A single resolution shall govern all PPH agreements.
NOTICE (10/05/20) Phase II of the PPH is planned to start on 12/1/22. Due to the success of the Patent Backlog Combat Plan and the current phase of the PPH, the Directorate of Patents, Software, and Topography of Integrated Circuits (DIRPA) is considering the possibility to anticipate phase II of the PPH to 1/1/21. The main differences proposed are described in the table below:
