Copies of patent applications
If the user is interested in obtaining copies of an entire patent application or of a part thereof, he must initially check the patent database in INPI’s portal to verify whether the document in which he is interested is already available.
Through the BuscaWeb system, INPI has made available the full content of an increasingly larger number of patent applications filed in Brazil. By accessing this system, the user may quickly view and download petitions and opinions. In order to view the entire content available of an application, however, the interested person must access the BuscaWeb necessarily using his login and password (the same ones used to generate the Brazilian Federal Revenue collection slip (GRU) and petitioning); if he does not have those yet, he must register to create them.
If the person interested in obtaining a copy of an application has already registered, he must follow the steps below:
- Access the BuscaWeb and, in the following menu, choose the entry Patente (Patent).
- Type the number of the patent application of interest, click on pesquisar (search) and then click on the application number once it appears.
The following page will include, in addition to the bibliographic data of the application, three lists: the first one are the annual fees paid for the application; the second one are its petitions; and the third one are its publications.
- In the list of petitions of the process, there will be links to PDF files with their images. It is worth noting that not all services require petitioning by forms to be effected (that is the case of annual fees, for example). For this reason, not all files will be accompanied by corresponding images.
- Later in the list of publications of the application, the PDF files of the expert and administrative opinions of the process will be available. (Older opinions that may not appear there may be included in the images of the petitions of that period).
Note: due to temporary limitations in the system, the images of documents issued before 2004 are being made available under service codes 848 and 849. Images made available under code 848 may include several petitions (or even the entire application) in a single digital file. The images made available under code 849, on their turn, always refer to a single petition.
