Documents required for Geographical Indication applications
As provided for in INPI’s Normative Instruction No. 95/2018, in order to file a Geographical Indication application with INPI, it is necessary, first, to generate and pay the Brazilian Federal Revenue collection slip (GRU) for this service.
Subsequently, the Electronic Petitioning form in the e-IG shall be filled out, based on the intended type (IP or DO).
The information of the person filing (applicant) and of the representative (if it is an application with a power of attorney) will be migrated automatically.
Additionally, data related to the Geographical Indication shall be informed, and the following documents shall be attached
A. Application filed by an association, union, or other Brazilian procedural representative
1. List of Technical Specifications;
2. Power of attorney, if the application includes a representative;
3. Proof of payment of the GRU;
4. Bylaws registered in the competent organ;
5. Registered minutes of the General Meeting with the approval of the Bylaws;
6. Registered minutes of the takeover of the current Board of Executive Officers;
7. Registered minutes of the General Meeting with the approval of the List of Technical Specifications and the attendance list;
8. Identity Card and Individual Taxpayer's Register (CPF) of the legal representatives of the procedural representative association;
9. Declaration stating that the producers or service providers are established in the delimited area (model II);
10. Documents evidencing that the geographical name has become known, in case of IP, OR documents evidencing the influence of the geographical environment in the qualities or characteristics of the product or service, in case of DO;
11. Official instrument that delimits the geographical area; and
12. Other documents that the applicant deems necessary.
Please note that applications filed by foreign applicants from countries that DO NOT count on reciprocal treatment with Brazilians shall submit the same documents listed above, plus the copy of the document that acknowledged the Geographical Indication in the country of origin. Additionally, it is mandatory to appoint a representative in Brazil.
B. Application filed by a single producer, individual or legal entity, established in the delimited area
1. List of Technical Specifications;
2. Power of attorney, if the application has a representative;
3. Proof of payment of the GRU;
4. Declaration stating that the individual is the only producer or service provider established in the delimited area (model III);
5.Documents evidencing that the geographical name has become known, in case of IP, OR documents evidencing the influence of the geographical environment in the qualities or characteristics of the product or service, in case of DO;
6. Official instrument that delimits the geographical area; and,
7. Other documents that the applicant deems necessary.
C. Application filed by a foreign applicant from a country that DOES count on reciprocal treatment with Brazilianss
1. Copy of the document that acknowledged the Geographical Indication in the country of origin;
2. Elements equivalent to the List of Technical Specifications;
3. Power of attorney;
4. Proof of payment of the GRU;
5. Official instrument that delimits the geographical area; and,
6. Other documents that the applicant deems necessary.
