TCCs approved by CADE’s Tribunal sum up to BRL 61 million
In the session of October 18 the Tribunal of the Administrative Council for Economic Defense – CADE approved four Cease and Desist Agreements (TCC in its acronym in Portuguese). Approximately BRL 61 million will be collected in pecuniary contribution.
The first case involve an ongoing investigation of an alleged cartel in the market of commercialization of products intended to the transmission and distribution of electric energy. The firms that signed a TCC with CADE are Alstom Brasil Energia e Transporte Ltda. and Grid Solutions Transmissão de Energia Ltda. (TCC nº 08700.002108/2016-27, related to the Administrative Proceeding 08012.001377/2006-52).
The alleged cartel harmed the competition in public and private biddings. The companies agreed to pay an amount of BRL 39,8 million.
Two others agreements refer to the domestic water meters’ market. (TCCs nº 08700.011036/2015-28 and nº 08700.011190/2015-08; both linked to the Administrative Proceeding 08700.009165/2015-56). The companies that reached an agreement with CADE are Itron Soluções para Energia e Água Ltda. and Elster Medição de Água S.A.
The above-mentioned companies also confessed their participation in rigging bids of water treatment and distribution companies. These companies will collect more than BRL 12 million in pecuniary contribution.
The fourth agreement (TCC nº 08700.001429/2015-23, linked to the Administrative Proceedings nº 08012.006130/2006-22 and nº 08012.005024/2011-99) refers to an investigation of an alleged cartel in the national market of buildings maintenance services. The firm Conbras Serviços Técnicos de Suporte S/A and 11 of its employees and former employees agreed to collect an amount of BRL 9,3 million.
The collected revenue will be reverted to the Fund for the Defense of Collective Rights (FDD in its acronym in Portuguese). The signatories confessed participation in the investigated conducts and agreed to cease them. Moreover, they will also contribute to the CADE’s investigation about the cases in question.
