General Superintendence opens procedure to investigate supposed cartel on parking lot’s market in São Paulo
The General Superintendence of the Administrative Council for Economic Defense opened last Thursday (Sep 11th) an administrative procedure (PA 08012.004422/2012-79) to investigate an alleged cartel in the market of exploration and management of parking lots in the City of São Paulo
There are signs that six companies and 17 people would have exchanged information and coordinated themselves to fix prices and divide costumers in the parking market. Besides that, the companies would have tried to gain advantages in private bids by presenting false proposals with the intention to simulate competition among them. Such anticompetitive conducts would have occurred between 2010 and 2011.
The evidence was obtained after a dawn raid held in April 2012 at the headquarters of one of the companies involved in the collusion.
With the opening of the proceedings, the accused will be notified to present their defense. At the end of the procedural instruction, CADE’s General Superintendence will issue an opinion for the condemnation or for the filing of the case and will refer the case to CADE’s Tribunal, responsible for the final decision.
