CADE suspends proceedings deadlines
With the end of Commissioner Paulo Burnier mandate in July 16, the Tribunal of the Administrative Council for Economic Defense (CADE, in its acronym in Portuguese) is now composed of only three members, until the appointment of new Commissioners by the President of the Republic.
According to article 6°, paragraph 5° and article 9°, paragraph 1° of the Law No 12.529/2011, as well as article 52, paragraph 5° of CADE’s Internal Regulation, the Tribunal's decisions shall be made by a majority, with the presence of at least four (4) members, provided that the minimum quorum to start deliberations shall be three (3) members. Otherwise, the deadlines and conduction of proceedings shall be deemed automatically suspended. Therefore, there will be no judgment sessions, counting of deadlines and conduction of proceedings until the appointment of the new Commissioners.
The counting of deadlines shall be immediately resumed upon reestablishment of the quorum.
