CADE signs agreements in cartel investigation of the national market of PVC pipelines
The Administrative Council for Economic Defense – CADE approved, in the session of November 23, two Cease and Desist Agreements (TCC in its acronym in Portuguese) that are related to a cartel investigation in the national market of PVC pipelines for sanitation infrastructure works (sewage and water) and to construction works (Administrative Proceeding nº 08700.003390/2016-60).
The companies that signed the first TCC were BR Plásticos Indústria Ltda. and BRP Indústria Plástica Ltda. Both companies are going to pay BRL 1,7 million to the Fund for the Defense of Diffuse Rights (FDD in its acronym in Portuguese), as pecuniary contributions.
The second TCC was signed with Nicoll Indústria Plástica Ltda. In this case, the pecuniary contribution reached the amount of BRL 5,6 million.
The agreements provides, besides the amount that must be paid to the FDD, the confession of the involvement of parties on the investigated conducts , and the presentation of evidences as part of the commitment and full cooperation with the investigation. With the signing of the TCCs, the administrative proceeding related to the three companies will remain suspended until the Administrative Tribunal of CADE declares that the companies fulfilled with the obligations established on the TCCs.
