CADE signed agreements in international cartel investigation in the market of manufacturing and selling of cathode ray tubes for color television image
On the judgment session of 4 October, the Tribunal of the Administrative Council for Economic Defense – CADE homologated two Cease and Desist Agreements (TCCs in its acronym in Portuguese) signed with Technicolor S/A and Chunghwa Picture Tubes, Ltd.. The agreements are related to investigations regarding an alleged cartel in the international market of manufacturing and selling of cathode ray tubes for color television image - CPT.
As a result of the agreements, BRL 15.4 million will be collected as a pecuniary contribution to the Fund for the Defense of Diffuse Rights (FDD in its acronym in Portuguese) of the Ministry of Justice and Public Security. From this amount, BRL 12,889,224.98 are linked to Technicolor and BRL 2,604,501.06 to Chunghwa. Commissioner Paulo Burnier was responsible for reporting the TCCs.
The collusion would have occurred between 1995 and 2007. The two TCC’s requirements refer to the Administrative Proceeding number 08012.002414/2009-92.
This proceeding had already relied upon two other TCCs, signed during the investigation phase at CADE’s General Superintendence. The signatories of these agreements are the companies Koninklijke Philips N.V., Philips do Brasil Ltda., LP Displays Amazônia Ltda., LP Displays International Limited and LG Eletronics Inc. e LG Eletronics do Brasil Ltda., besides four individuals.
CDT and LCD
Some of the companies, which are defendants in this case, are also being targeted in the administrative proceedings 08012.010338/2009-99 and 08012.011980/2008-12 - that also relied upon the signature of TCCs.
The first proceeding investigates a collusive practice in the market of color display tubes – CRT/CDT. The product is a component of some types of tube monitors mainly used in personal computers (PCs) and televisions. The second proceeding investigates a cartel in the Brazilian market of Thin-film-transistor liquid-crystal display – TFT/LCD. The product is the main component of monitors and notebooks.
The agreements related to these proceedings, signed with Chunghwa, were homologated on CADE’s Tribunal session of 20 September 2017. The Reporting Commissioner was Mr. Mauricio Bandeira Maia.
