CADE releases new edition of its Revista de Defesa da Concorrência
On 17 June, the Administrative Council for Economic Defense (CADE) released the first 2021 issue of its Revista de Defesa da Concorrência (Journal of Competition Defence). CADE’s biannual publication is aimed at expanding the literature on competition law.
In its eight papers, the Journal addressed different relevant, present-day antitrust matters, such as excessive pricing and the fight against Covid-19, new theories of harm applied to digital platforms, and banking competition and open banking in Brazil.
One of the papers covers the Casas Bahia–Ponto Frio merger. Another one looks into the participation of third parties in merger review cases, based on the analysis of Brazilian cases in the light of the experiences of the European Union and France.
The new issue also includes a study on accessing leniency programme documents for purposes of private enforcement in Brazil and the European Union. Moreover, EU's legislation and its conviction of Google was the topic of yet another piece of research. Finally, the Journal closes with a study on arbitration and competition law, addressing the public policy doctrine, confidentiality, and the role of arbitrators.
Prepared by experts in the field, the papers are selected by the Journal's referees. Papers are accepted all year round, in Portuguese, English, Spanish, or French.
History
CADE's first regular publication on competition law started in 1975, under the title Revista de Direito Econômico (in translation, Journal of Economic Law). In 2004, the publication was renamed Revista de Direito da Concorrência (in translation, Journal of Competition Defense), and in 2013 it was given its current title: Revista de Defesa da Concorrência, or Journal of Competition Defence.
With only two years of history, the Brazilian agency responsible for quality assurance in higher education institutions, Capes, graded the journal a B2 under its Qualis programme; in the following evaluation, the journal improved to a B1. The Qualis programme regularly measures the quality of academic journals, with grades ranging from A to C, in a 1–8 scale: A1, A2, B1, B2, B3, B4, B5, and C, where A1 is the highest grade.
As relevant publications in the antitrust literature, CADE has decided to make available all issues of its former Revista de Direito da Concorrência.
