CADE releases a second report on digital economy
On 02 February, the Administrative Council for Economic Defense (CADE) released the report Brics in the Digital Economy: Competition Policy in Practice (2nd Report). This report aims to show the results of the working group created in 2017 during the 5th BRICS International Competition Conference, in Brasília.
This series of documents aims to enhance the understanding of competition policies in the digital economy and to improve future cooperation among the authorities.
The purpose of the second report, which is non-binding, is to improve the debate on digital markets, either in the review of mergers and acquisitions, or anticompetitive practices in the digital environment. The report identifies common points and promotes the discussion on some of the main characteristics of digital markets.
Among the topics addressed in the document are the definition of “relevant market” in digital markets, criteria for assessing market power, analysis of the specific challenges raised in cases of anticompetitive practices, mergers, and remedies in digital markets, among others.
The first report was released in 2019 during the 6th BRICS International Competition Conference, held in Moscow, Russia. The document provides an overview of the competition policy and enforcement of the BRICS countries, addressing different experiences to enforce antitrust laws, and exploring challenges and insights of representatives from all BRICS countries.
The working group was created after a questionnaire that examined the practices and challenges in the scope of digital economy by competition authorities from Brazil, Russia, India, China, and South Africa. The goal is to create a document that is used as a solid foundation for the BRICS countries to strengthen their cooperation.
