Cade releases a commemorative issue of Revista de Defesa da Concorrência

Last Wednesday (17 June), the Administrative Council for Economic Defense (Cade) launched the 15th issue of Revista de Defesa da Concorrência (Journal of Competition Defense). This commemorative edition celebrates fifteen published numbers and the consolidation of the journal - aimed at promoting academic production on competition defence - in the antitrust literature.

Cade published its first periodical title on policies of competition defence in 1975, called Revista de Direito Econômico (Journal of Economic Law). In 2004, it was renamed Revista de Direito da Concorrência (Journal of Competition Law) and in 2013 it gained its current title, Revista de Defesa da Concorrência (Journal of Competition Defense).

In 2015, after only two years of publication, the journal was ranked B2 by Capes (a body linked to the Ministry of Education) in the Qualis programme, which assesses scientific publications. In the following evaluation, it was rated B1. The Capes index is regularly updated and ranks the quality of academic journals as A1, A2, B1, B2, B3, B4, B5, and C, where A1 is the highest rate.

"We intend to keep making progress in this and other quality metrics. The consolidation of the journal in different regions of Brazil and abroad, its indexation in specialised portals, and the digital accreditation of its material are important advances the editorial staff pursues. The positive results obtained so far encourage us to take on these challenges”, said the president of Cade, Alexandre Barreto.

Articles in this edition

The current edition includes nine articles on current and relevant competition defense topics. The first two address the COVID-19 pandemics, the obstacles it poses for competition, and measures Cade could implement in this new scenario. The third article analyses the concentration in the Brazilian mobile telephony market from 2011 to 2019, affected by increased consumer demand and pressure for technological innovation.

Another article conducts a systematic analysis of the legal criteria employed in establishing appropriate penalties for competition violations. The fifth article examines vertical integration in the port sector, looking into port storage in the state of Santa Catarina. The sixth one discusses the right to data portability and its beneficial effect on competition, as well as possible diversions, in the light of the Brazilian and European law.

The last three ones are an investigation into copyright in relation to competition defence; a comparison of the leniency programmes of Cade and the Office of the Comptroller General; and an analysis of the imposition of social obligations to businesses.
