CADE launches study on digital platforms
On 6 August, the Administrative Council for Economic Defense (CADE) launched a study on the market of digital platforms. This is the 12th issue of the series "Review of CADE's Decisions", which aims at presenting the Council's case law on M&A activity and anticompetitive practices involving the market of services hired over the internet.
In better understanding and defining digital markets, the document addresses the most general characteristics of these platforms, including costs, innovation, and business models. Moreover, considering these applications collect and use data, the document discusses how they connect with Brazilian General Data Protection Law.
In this same context, the document approaches the issue of net neutrality, which aims to ensure end users are provided with digital services in an equal manner, without discrimination based on content, source address, destination address, type of equipment, or application.
Finally, the study analyses CADE's case law related to M&A activity and illegal activities that have undergone the agency's investigations. The analysis covers several markets that employ digital platforms, such as social media, audio streaming, video on demand, on-line tourism and food delivery applications.
According to the publication, Brazil is the second fastest growing country regarding the application market, which proves the economic relevance of these platforms in the country. In the light of this, CADE has been looking at these markets, which are increasingly present in peoples' lives.
"Through this document, institutional publications, cooperation with other antitrust agencies, seminars, and trainings, CADE has shown its constant engagement with self-evaluation and preparation to approach matters of the digital economy, which has a fast pace of innovation", mentions the document.
Launched in 2015, the series of studies "Review of CADE's Decisions" aims at consolidating, systematising, and publicising the agency's case law related to a specific market, considering its economic and competitive aspects.
