CADE launches public consultation to update its leniency guidelines

The Administrative Council for Economic Defense (CADE) launched a public consultation to update the “Guidelines: CADE’s Antitrust Leniency Program”. Until 20 December 2024 , the document will be available to receive contributions from society and legal community. The announcement of the consultation happened during the 30th International Seminar on Competition Defence.
The document update is the result of the work of the Antitrust Leniency Working Group, an initiative from the Office of the General Superintendent at CADE (SG), established in 2023. The meetings gathered about 100 participants who discussed several topics related to CADE’s Leniency Program. The previous update occurred in 2017.
In 2024, there were six meetings where the group enabled the participation of external agents with contributions, recommendations, and suggestions, to improve the leniency agreement proceedings.
The Assistant Superintendent at CADE, Fernanda Machado, highlighted the importance of the collaborations throughout the year to make agreements more agile and reliable, while reinforcing the commitment to effective investigations.
“Streghthening the dialogue between all the parties involved in the leniency programme is essential to make agreements faster and more efficient, while preserving legal certainty. After the collaboration of various agents, we were able to improve the negotiation and to make sure that the investigations are concluded with accuracy, so the results are faster and more consistent,” she emphasised.
