CADE launches administrative procedure to investigate airlines
On 15 July, the Office of the Superintendent General of CADE launched an administrative procedure related to a codeshare agreement between Azul and Gol, announced in May 2024.
By the end of the investigation, CADE can decide to dismiss the procedure, decide that the transaction was completed in disagreement with the Brazilian Competition Law (Law 12529/2011), or open an administrative procedure.
Thus, if CADE finds the defendants guilty, a fine can be established from BRL 60 thousand to BRL 60 million, in addition to a required notice.
The Brazilian antitrust authority uses administrative procedures to investigate merger agreements with required notice consummated before CADE's clearance.
The fact that CADE launched a procedure does not mean that the parties must notify the transaction or that there are competition concerns. After the discovery phase, the Office of the Superintendent General is to submit the case to CADE's Tribunal for hearing.
