CADE develops a system to automate pre-merger notification
The goal of e-Notifica, the new system of the Administrative Council for Economic Defense (CADE), is to have fully digital mergers. The pre-merger notification process will be automated and available to external users this December.
In addition to digitalising merger filings with CADE, e-Notifica will speed up the filling out process, as the tool is already integrated with the Brazilian government and CADE's database. Thus, mandatory and optional information will be automatically filled in, such as the Brazilian classification of economic activities (CNAE-Brasil), the list of mergers reported to CADE, and the names of shareholders that hold seats on the boards of other companies. E-Notifica displays a progress bar for users to track their progress while filling out the required information.
E-Notifica will be available on CADE's website at Gov.Br, under “item Usuário Externo do SEI” (in Portuguese only). The unit gives access to the list of complaints, ongoing complaints, and cases available for signatures.
Other features include the ability to save the draft notice before submission and share the notice externally or internally. Thus, a lawyer, for example, can share a draft externally, if necessary.
Besides, citizens can now conveniently pay fees through Sistema PagTesouro using PIX (instant payment system from the Central Bank of Brazil) or credit cards, improving their overall payment experience.
The project aims to establish efficient merger control, in line with CADE’s strategic plan for 2021-2024, mainly the Contribution to Society section.
