CADE approves resolution that implements the agency’s electronic protocol
The Tribunal of the Administrative Council for Economic Defense (CADE) approved, on 14 October 2015, the Resolution No. 14 that implements the agency’s electronic protocol.
The development of the platform is comprised in the second phase of Project Paperless CADE, which started with the implementation of the Electronic Information System (SEI in its acronym in Portuguese) in January of 2015.
The first service available at CADE’s electronic protocol will be the notification of merger transactions. Afterwards, the system will allow for the submission of other petitions by digital means. The physical protocol unit at CADE’s headquarters will continue to operate during normal business hours.
The adoption of the electronic protocol and the electronic notification of merger transactions are targets of the Strategic Plan 2013-2016 and of the Pluriannual Plan (PPA in its acronym in Portuguese) 2012-2015 of the Federal Government.
The Resolution was object of public consultation and will enter into effect in the date of publication in the Official Gazette.
“CADE has received valuable contributions that helped to clarify some points of the resolution”, said the President of CADE, Vinicius Marques de Carvalho, also quoting suggestions from both individuals and the Brazilian Bar Association (OAB in the acronym in Portuguese) sections in the Federal District and in the State of São Paulo.
The second phase of the Project Paperless CADE is supported by Instituto Brasileiro de Estudos de Concorrência, Consumo e Comércio Internacional (IBRAC), OAB-SP, OAB-DF and OAB Federal Council. The entities helped with specifications and tests of the platform, as well as with the promotion of the new service.
