CADE launches investigation in the light vehicles international market
On 15 July, the Office of the Superintendent General of CADE (SG/CADE) launched an administrative proceeding to examine alleged antitrust violations in the international market of light-duty vehicles.
This is the first case in which competitors are investigated for seeking to reduce innovation in Brazil. CADE investigates six companies and 23 individuals for alleged exchange of competitively sensitive information to coordinate research and development activities.
Upon launching the administrative proceeding, the defendants will be notified to file their defence. After the discovery phase, the Office of the Superintendent General will either find the defendants guilty or dismiss the case, submitting it to the Tribunal of CADE for a final decision.
If convicted, the companies can be fined 0.1% to 20% of their turnover, in addition to other penalties. The individuals involved are subject to fines ranging from BRL 50 thousand to BRL 2 billion. Administrators are fined 1% to 20% from the amount imposed on their company.
Once CADE declares the conditions of the leniency agreement have been fulfilled, the authority is to order, in favour of the signatories, total immunity from fines and other penalties.
