Department of Economic Studies
The Department of Economic Studies (DEE) was created in 2009 based on CADE Resolution 53/2009, as an advisory body to the Office of the President and CADE’s Administrative Tribunal. Later, Law 12529/2011, which restructured the Brazilian Competition Defense System, formally established the Department of Economic Studies as one of CADE’s constituent bodies, along with the Office of the Superintendent General, and the Administrative Tribunal for Economic Defense (Article 5).
Duties and Responsibilities
The Department of Economic Studies (DEE) carries out a range of functions grouped into two complementary areas of activity:
First, to provide technical advice to the Office of the Superintendent General and the Administrative Tribunal for Economic Defense in the preparation and analysis of administrative proceedings concerning merger cases and anticompetitive conduct;
Second, to conduct research that ensures CADE’s continuous technical and scientific development.
The DEE is responsible for preparing economic studies and opinions, either on its initiative or at the request of the Tribunal Plenary, the President, the Rapporteur Commissioner, or the General Superintendent, with a focus on maintaining the technical and scientific quality of CADE’s decisions. Sole Paragraph. The Department of Economic Studies may request the Office of the Superintendent General, to demand information as provided for in Article 13, Item 2, of Law 12529/2011.
DUTIES AND RESPONSIBILITIES OF THE COORDINATION FOR MERGER REVIEW STUDIES
I – To prepare economic studies and opinions to support merger reviews, ensuring the technical and scientific quality of CADE’s decisions;
II – To assist CADE’s bodies in merger reviews.
DUTIES AND RESPONSIBILITIES OF THE MARKET STUDIES, MONITORING, AND EVALUATION SERVICE
1 – To prepare economic studies and opinions to monitor and evaluate the status of merger cases, ensuring the technical and scientific quality of CADE’s decisions;
2 – To assist CADE’s bodies in the monitoring and evaluation of merger cases.
DUTIES AND RESPONSIBILITIES OF THE COORDINATION FOR ANTICOMPETITIVE CONDUCT STUDIES
1 – To prepare economic studies and opinions to support the analysis and identification of anticompetitive conducts, ensuring the technical and scientific quality of CADE’s decisions;
2 – To assist CADE’s bodies in the analysis of anticompetitive practices.
DUTIES AND RESPONSIBILITIES OF THE CARTEL ANALYSIS AND STUDIES SERVICE
1 – To prepare economic studies and opinions to support the analysis and detection of cartels, ensuring the technical and scientific quality of CADE’s decisions;
2 – To assist CADE’s bodies in the analysis and identification of cartels.
DUTIES AND RESPONSIBILITIES OF THE COORDINATION FOR MARKET STUDIES AND COMPETITION ADVOCACY
1 – To prepare economic studies on competition defence, competition advocacy opinions, and market research to monitor and evaluate competitive conditions in relevant sectors, ensuring the technical and scientific quality of CADE’s decisions;
2 – To conduct courses and events to promote and disseminate competition culture;
3 – To assist CADE’s bodies in the analysis and identification of competition advocacy matters.
