ANPD's Regulatory Sandbox Featured at report of the World Economic Forum
The Artificial Intelligence and Data Protection Sandbox Pilot Project, led by the Brazilian Data Protection Authority (ANPD), was mentioned in the Artificial Intelligence Governance Report, published by the World Economic Forum. The organization, headquartered in Geneva, Switzerland, aims to foster global cooperation from political, economic, and inter-country interaction perspectives.
The document states that, in light of the rapid evolution of Artificial Intelligence (AI), it is essential to establish agile and flexible governance parameters. The Forum's analysis suggests that, in addition to the already established legal mechanisms, adaptable regulations should be developed to enable society to meet the future challenges posed by AI.
In this context, the ANPD's regulatory sandbox was mentioned as an exemplary initiative. Through innovation in a controlled environment, the project will enable the creation of control mechanisms commensurate with technological innovations. This initiative has also placed Brazil in a pioneering position in regulatory sandboxes, alongside Singapore, the United States, the United Arab Emirates, the United Kingdom, the European Union, and Mauritius.
"The reference to our project indicates that the technological parameters established by the ANPD are correct. The mention also opens the opportunity for us to become a benchmark for sandboxes in other regions," celebrates Thiago Moraes, the Coordinator of Innovation and Research at the ANPD.
Currently, the Artificial Intelligence and Data Protection Sandbox Pilot Project is in the phase of analyzing the 71 contributions received through public consultation. Of these, 35 were from private entities or economic groups; 5 from the public sector; 10 from civil society; 6 from academia; and 15 from citizens. Out of these contributions, 66 originated from Brazil, and 5 came from abroad.
Sandbox
The regulatory sandbox is a collaborative experimentation among the regulator, the regulated entity, and other stakeholders. The goal is to test regulatory innovations in a controlled space, using a structured methodology. The expression "sandbox" refers to an environment for building structures that can be easily remodeled or reconstructed due to the malleable material they are composed of.
According to Waldemar Gonçalves, the President-Director of ANPD, the project will result in benefits for the entire society. “Testing allows us to explore the ramifications of technology, prioritizing justice, data protection, and the rights of individuals. In this way, society can enjoy the prospect of technological development with an ethical approach,” he states.
Participants, in turn, benefit from engaging in a collaborative experience in a multistakeholder environment. The experiences and learning are relevant for all actors: innovative companies, experts, regulators, consumers, public authorities, non-governmental organizations, and civil society organizations.
