ANPD's Call for Contributions to the regulatory sandbox for artificial intelligence and data protection in Brazil is now open
Autoridade Nacional de Proteção de Dados (ANPD), the Brazilian Data Protection Authority, published today, October 3rd, a call for contributions on its regulatory sandbox pilot program. Stakeholders can participate through the Participa + Brasil Plataform until November 1st. Contributions are accepted from both the public and private sectors. The Platform also provides a session for international contributions (in English).
The program consists of a controlled environment to test technologies associated with artificial intelligence (AI) developed by participants. The objective is that by fostering innovation in this controlled space, good practices are implemented to ensure compliance with personal data protection rules and principles.
The regulatory sandbox project led by ANPD is supported by the benchmark study “Sandbox regulatório de inteligência artificial e proteção de dados no Brasil” (available only in Portuguese). Prepared by the Autarchy, this document aims to present how regulatory sandboxes can be used by a Data Protection Authority to contribute to the regulation of emerging technologies.
ANPD's regulatory sandbox pilot is being designed in collaboration with the Development Bank of Latin America and the Caribbean (CAF), which shared methodologies, knowledge, and experiences for developing regulatory sandboxes in the region.
"The current debates on AI regulation present an opportune moment to build a pilot sandbox program on this technology. The sandbox will both foster innovation and protect fundamental rights, such as privacy and personal data protection", highlights the Director-President of ANPD, Waldemar Gonçalves.
REGULATORY SANDBOX
A regulatory sandbox is a collaborative experimentation between the regulator, regulated entities, and other stakeholders - such as technology and innovation companies, academics, and civil society organizations - intending to test innovations within a regulatory framework by adopting a structured methodology.
In the case of the pilot program developed by ANPD, the sandbox is an important regulatory tool. It will bring relevant outputs to future norms on the subject, to increase algorithmic transparency and promote responsible innovation in AI.
CALL FOR CONTRIBUTIONS
The Call for Contributions will be available on the Participa + Brasil Plataform for the next 30 days and will end on November 1st, 2023. It will be the only accepted channel for sending contributions to the ANPD. International contributions are also welcome, and there is a particular session in English on the Platform.
In this Consultation, information and data relevant to the regulatory sandbox will be collected, allowing an understanding of the perspectives of different interested actors who may be affected by future regulation in the fields of Artificial Intelligence and data protection. Both public and private sector contributions are accepted. All contributions made are available for Consultation upon login. The Platform also allows contributions from foreign institutions.
Consultation of this nature allows for a broader range of input, ensuring transparency and inclusion in the Authority's decision-making process. Furthermore, the Consultation provides an opportunity for interested parties to express their views, raise concerns, and contribute information to shape the structure of the sandbox.
