Those interested in participating in the Open Acreage of Concession (OPC) must submit their application for registration in accordance with the terms of the current tender protocol. The interested party whose application for registration is approved by CEL and whose registration documents are up to date will be considered a bidder.
Registration for the OPC may be submitted using the form available here.
The submission for the Open Acreage process is individual and mandatory for each interested company, even for those intending to submit through a consortium.
To participate, the interested company shall:
I) Fulfill the submission electronic form;
II) Submit the documents detailed on the tender protocol; and
III) Sumit letter of presentation, exclusively for interested parties that do not have an oil and natural gas exploration and production agreement in force in Brazil.
Once all of the tender protocol requirements are satisfied as well as the law dispositions, domestic and foreign legal entities, individually or in a consortium, can participate in OPC. Private equity funds (FIPs) can participate as non operator, being allowed only to submit the bid through a consortium.
The applications will be judged by CEL and, if approved, the bidders will be included in the list of bidders for the Open Acreage of Concession. The result of the applications will be communicated to the bidders individually by email.
Only bidders included in the latest list of bidders for the Open Acreage of Concession published by ANP and available here may participate in a cycle of the Open Acreage of Concession.
Applications for registration are judged by Bidding Round Special Commission (CEL) and if they meet all the requirements set out in section 4 of the tender protocol, they will be approved and will be able to participate in the bidding cycles of the Open Acreage of Concession.
To present an offer individually in the public bid presentation session of a cycle, the registered bidder must present a declaration of interest accompanied by an offer guarantee. In consortium offers, the declaration of interest may be presented by only one of the bidders, who must also provide offer guarantees.
Pursuant to section 13 of the tender protocol, the decision-making acts of CEL regarding the registration may be an administrative appeal, to be received only in the return effect, within 5 (five) business days from the date of publication of the contested act in the Official Gazette (DOU).
