Bidders Submission
Notice:
According to Board Resolution No. 754/2023, the Tender Protocol of Open Acreage of Concession (OPC) and the Tender Protocol of Open Acreage of Production Sharing (OPP) are revoked.
We highlight that the present revocation of the tender protocols only affects future cycles, and does not affect the schedule and the next stages of the 4th Cycle of the Open Acreage of Concession and the 2nd Cycle of the Open Acreage of Production Sharing, including the qualification of bidders winners, the award and approval of the result and the signing of contracts.
- How to do the submission for the Open Acreage?
The ANP informs that registrations are temporarily suspended due to the revocation of the tender protocol.
The submission for the Open Acreage Process is individual and mandatory for each interested company, even for those intending to submit through a consortium.
To participate, the interested company shall:
I) Fulfill the submission electronic form;
II) Submit the documents detailed on the Tender Protocol; and
III) Pay the participation fee.Since all the Tender Protocol requirements are satisfied, as well as the law dispositions, can participate the domestic and foreign legal entities, individually or in a consortium, and the private equity funds (FIPs), as non operator, being allowed only to submit the bid through a consortium.
I) Filling the submission electronic form:
The interested companies must, individually, fulfill the electronic submission form.
In the electronic form, those interested must fill the fields informing the address, the corporate group, the main accredited before ANP, the controlling shareholder, as well as all members of the management structure.
In addition to the main accredited representative, the other accredited representatives shall be appointed through a power of attorney.
After the procedure of fulfill and sending the form, the accredited representative will receive a message confirming the request of submission in the informed e-mail. In case of not receiving, please, contact ANP through the e-mail rodadas@anp.gov.br .
II) Submitting the documents
The submission, to be effective, requires the following documents – as detailed in the Tender Protocol - to be presented by the companies:
a) Corporate documents
b) Appointment of accredited representatives
c) Ownership structure
d) Declaration of technical, economic, and financial capacity and legal, tax and labor compliance
e) Commitment to adjust the corporate purpose
f) Additional documentation for enrollment of a foreign bidder
g) Documents for enrollment of FIPs, when it is the case.III) Participation fee payment and access to the sample of technical data
The bidders must pay the participation fee for submission, which is R$2.250,00 (Two thousand, two hundred, fifty reais).
The fee payment is mandatory and individual for each bidder, even those who will present their offer through a consortium.
The participation fee must be paid by bank transfer, available at the link below.
This sample of the technical data is a small amount of the data about exploration wells and seismic lines for each one of the sectors in the Open Acreage.
This sample may not be taken by whole technical data package, that is the subject of the 5th Table of the Tender Protocol.
III.1) Payments made in Brazil
Payment of the participation fee in national currency must be made by bank slip.
III.2) Payments made abroad
Payment of the participation fee in foreign currency shall be made through wire transfer in U.S. Dollars. The amount of the participation fee shall be converted into U.S. Dollars by mandatorily using the official buying exchange rate (BACEN/Ptax buying) of the business day immediately before payment, published by the Central Bank of Brazil.
The bidder shall verify, before the financial institution in charge of the transaction, the accrual of rates on the wire transfer, in order to ensure that the precise amount of the participation fee provided for in Table 4.3 of Tender Protocol is effectively available to ANP after conversion into Reais.
To easily identify the transfer, the proof of the bank transaction must be send to SPL, to the e-mail rodadas@anp.gov.br.

The REATE Program (Program for the Revitalization of Oil and Natural Gas Exploration and Production Activity in Land Areas) is a National Policy to promote the exploration and production of oil and natural gas in land areas in Brazil, in order to provide the regional development and stimulate national competitiveness. The REATE Program makes available all public data on terrestrial sedimentary basins that appear in the ANP database.
The PROMAR Program (Program for Revitalization and Incentive for Production of Maritime Fields) aims to create conditions for the revitalization of mature maritime fields and better conditions for the economic use of accumulations of oil and natural gas considered to be of marginal economicity, also located at sea. The PROMAR Program partially makes available public data on marine sedimentary basins available in the ANP database.
III.3) Procedures for removing the Technical Data Sample
The data sample can be collected online (download), through a request sent to the institutional email: rodadas@anp.gov.br.
Alternatively, the company may request the in-person collection of the Technical Data Sample via e-mail rodadas@anp.gov.br, to be carried out at ANP/Urca, located at Av. Pasteur, nº 404, blocks A4, Urca , Rio de Janeiro - RJ. Instructions for scheduling in-person pick-up will then be sent.
In the case of in-person pick-up, after scheduling, the company must deliver directly to the Exploration and Production Database (BDEP) a new external hard drive (HD), in sealed packaging, with a minimum storage capacity of 1 TB, for the recording of technical data. Next, the responsible team will record the HD and schedule the date for removing the HD with the recording.
The data sample may be taken:
a) by an accredited representative;
b) by a person authorized by the accredited representativeATTENTION:

IV - Submission Approval
Will be approved the bidders that fulfill all the requirements of the Tender Protocol.
The submissions will be judged by CEL and the results will be told to the bidders, individually, by e-mail.
Until the Public Offers Session for each Cycle of the Open Acreage a list of the bidders will be published at the website https://www.gov.br/anp/.
The bidder with registration approved by CEL may submit offers for any blocks or areas, as long as they have presented a guarantee of offer accompanied by a declaration of interest, in accordance with section 6 of the Tender Protocol.

Applications for registration are judged by Bidding Round Special Commission (CEL) and if they meet all the requirements set out in section 4 of the Tender Protocol, they will be approved and will be able to participate in the bidding cycles of the Open Acreage of Concession.
To present an offer individually in the public bid presentation session of a cycle, the registered bidder must present a declaration of interest accompanied by an offer guarantee. In consortium offers, the declaration of interest may be presented by only one of the bidders, who must also provide offer guarantees.
Pursuant to section 13 of the Tender Protocol, the decision-making acts of CEL regarding the registration may be an administrative appeal, to be received only in the return effect, within 5 (five) business days from the date of publication of the contested act in the Official Gazette (DOU).
