Symposium celebrates 10 years of the Cape Town Convention in Brazil and addresses challenges

The National Civil Aviation Agency (ANAC) promoted on June 15 and 16 the commemorative symposium “Ten Years of the Cape Town Convention – Internalization of the Convention and its aeronautical protocol by Brazil”.
The event was opened by director Ricardo Catanant, who emphasized that the Convention represents a milestone in international law, besides playing a vital role in the economy. Catanant emphasized ANAC’s role in ensuring operational safety by mentioning the Agency’s positive results in the latest audit conducted by the International Civil Aviation Organization (ICAO). About the event, the director pointed out that it is an opportunity to strengthen the relationship between the actors involved in the implementation of the Convention on International Interests in Mobile Equipment. “It is important to overcome the challenges and maximize the benefits of the Cape Town Convention,” he stressed.
Next, Marco Santin, Deputy Head of Department of Airworthiness, launched the Commemorative Compendium – Ten Years of the Internalization of the Cape Town Convention and its Aeronautical Protocol. The compendium is a collective work and represents an important initiative of ANAC to encourage the production of scientific articles on the subject, which, because it is a legal matter of specific application, still has little literature nationwide.
The symposium was attended by experts in aviation and aviation law both nationally and internationally. The topics covered included presentations on the importance of the Convention for the development of international law and for the aviation industry; the legislation and evolution of the models related to transnational recovery and insolvency; lessons learned in maximizing the benefits of the Convention; the history of the adoption of the Convention in Brazil; as well as case studies and challenges to the effectiveness of international treaties under Brazilian law.
Debate panels
During the two days of the event, debate panels addressing concrete cases and discussions on the legal scenario were held with the themes “Legal measures applicable in light of the Cape Town Convention”, “The Cape Town Convention, reorganization/insolvency proceedings and Brazilian aviation” and “International relations and the enforcement of foreign judicial orders related to the Cape Town Convention in Brazil”.
