ANAC publishes English version of the Guide on Aeronautical Products Import
The Brazilian National Civil Aviation Agency published this week the English version of the Guide on Aeronautical Products Import, containing guidance related to the import of civil aeronautical products and their subsequent use in Brazil. The Guide is focused on importers, custom brokers, aircraft operators and maintenance organizations.
The Guide consolidates the main aspects of ANAC regulations affecting the import of aeronautical products and their use in Brazil, especially those contained in the Brazilian Civil Aviation Regulations (RBAC) No 21 (Aeronautical product and article certification), 43 (Maintenance, preventive maintenance, rebuilding and alteration), 45 (Identification, nationality and registration marks) and 91 (General requirements for the operation of civil aircraft), in ANAC Resolution No 293/2013 (Brazilian Aeronautical Registry) and in Supplementary Instruction (IS) No 21-010 (Procedures for the approval of foreign civil aeronautical products and the importation of any civil aeronautical products).
Through the guide, users will be able to:
a) Identify whether or not the product is type-certified;
b) Know which products are prohibited for use in Brazil and, therefore, subject to administrative measures from ANAC and the customs authority;
c) Consult main documents to be obtained and checked, within the scope of ANAC competencies, when importing aeronautical products;
d) Know what the export airworthiness approval, issued by the civil aviation authority of the export country, is and when it is required;
e) Understand the need to comply with international agreements in force; and
f) Comprehend the main aspects of markings and traceability of civil aeronautical products.
Prevention of Non-compliant Imports
Throughout last years, ANAC carried out, alongside police and customs authorities, several operations where evidences of non-compliant imports of aircraft, engines, propellers and articles were found, notably of accident aircraft, also known as “salvage” aircraft.
Since then, ANAC and the customs authority, the Federal Revenue of Brazil (RFB), started a project for preventing non-compliant imports of aeronautical products to Brazil, by means of coordinated actions from both authorities.
Amongst the results of that project, it is highlighted the update of Supplementary Instruction (IS) N. 21-010 and the development of the Guide on Aeronautical Products Import, consolidating the guidance related to existing import requirements, helping importers, preventing non-compliant imports and supporting RFB in the repression of such non-compliances.
Issuance of revision F of IS No 21-010
IS No. 21-010 contains procedures for the approval and import of foreign civil aeronautical products. In 2022, a specific section for customs aspects was included in revision D of the IS. Recently, revision F of that IS was published, correcting issues related to the import of used light-sport aircraft.
RBAC No. 21 does not allow the issuance of a certificate of airworthiness to light-sport aircraft imported in used condition, preventing the lawful use in Brazil of such aircraft.
