ANAC opens public consultation on Type Design Data with Relevant Effects to the Operational Context
The Brazilian National Civil Aviation Agency (ANAC) opened, this Monday, April 3, a public consultation with proposals to change the Brazilian Civil Aviation Regulations (RBAC) n° 01, 21 and 61, related to Theme 1 of the Regulatory Agenda: Type Design Data with Relevant Effects to the Operational Context. The proposed changes include:
- Updated Minimum Equipment List (MEL) and Master Minimum Equipment List (MMEL) definitions in RBAC No. 01;
- Inclusion of requirements for MMEL and aircraft operational evaluation in RBAC No. 21; and
- Update of requirements for granting and maintaining type ratings, improving therefore the link with the result of the operational evaluation, in RBAC No. 61.
The Regulatory Impact Analysis (RIA) report that led to the regulatory changes mentioned above is submitted for consultation as well. During the RIA, the regulatory problem was studied in detail, including workshops with affected agents in Brazil and abroad and meetings with the Federal Aviation Administration (FAA) and the European Union Aviation Safety Agency (EASA).
As a result, ANAC proposes the adoption of an improvement package that is inspired by the EASA regulation, but in a less restrictive way, without making the MMEL and the result of the operational evaluation part of the type certificate, for example.

- Public consultation notice (Portuguese only). This document was published on the Federal Official Journal and establishes May 18th as the last day for submitting contributions;
- Justification (English version available), containing the legal basis for proposing the changes, a summary of the Regulatory Impact Assessment and a general description of normative changes;
- Comparative chart (English version available), highlighting changes item per item, along with foreign reference regulation and a detailed justification;
- Draft RBAC n° 01, 21 and 61 (Portuguese only), compiling proposed changes into the full regulation documents;
- Draft ANAC Resolution (Portuguese only), which will be the document issued by the Board of Directors for changing the RBAC; and
- Board of Directors decision (Portuguese only) for submitting this theme for public consultation.
Justification and the Comparative Chart were translated into English for encouraging the participation of foreign companies and professionals.
Webinars in Portuguese (04/18) and English (04/19)
With the purpose of explaining the normative theme, clarifying doubts and encouraging the contributions in the Public Consultation, ANAC will promote two webinars, where the RIA and proposed changes will be explained and interested parties will be able to clarify their doubts on the subject.
The events will be broadcast live on the ANAC YouTube channel. Doubts can be sent beforehand or during the event to gtni.sar@anac.gov.br, or verbally by previously registered participants. Those interested in submitting questions verbally should request their participation at eventos@anac.gov.br. Requests must be made no later than April 14th.
ATTENTION: The webinars will NOT be Public Hearing sessions to collect oral contributions for the public consultation. All contributions must be sent in writing using the electronic form abovementioned.
