The Voo Simples Law is sanctioned and will guarantee modernization and more investments in Brazilian aviation
Simplification, more efficiency, more development and less costs to the Brazilian aviation. These are some of the benefits that Law 14.368/2022, better known as the Voo Simples Law, sanctioned on June 15th, by the Federal Government (available only in Portuguese), will bring to the airline industry and to the country. The new law also contributes to updating outdated rules in norms that discipline Brazilian aviation towards international best practices.
In practice, the sanction makes it possible for aviation services to be more efficient and less bureaucratic, thus providing cost reductions for the sector and for the administration. Among the many benefits of the bill are certification processes that are better tailored to the needs of the regulated parties, and a focus on delivering value to society with air transport that is increasingly inclusive, universal, efficient, and modern.
Among the main points, the law consolidates the understanding that air services are considered an economic activity of public interest, dispensing with various bureaucratic procedures for the operation of airlines in the country, which did not add security to operations. On the way to enable the expansion of air transport, it is worth noting the facilitation of the process for the operation of new airlines in Brazil, with the elimination of unnecessary authorizations and concessions.
According to the director-president of the National Civil Aviation Agency (ANAC), Juliano Noman, the initiative will allow the improvement of the business environment, the attraction of investments and the reduction of costs for the sector and for the administration, essential in the process of resumption of Brazilian civil aviation in the post-pandemic scenario. "With the reduction of bureaucracy, the Agency will be able to focus its resources on promoting the safety of the country's civil aviation," he said.
“The Voo Simples proposals will reduce aviation costs, unlock investments in our infrastructure and, most importantly, generate jobs. We now have a leaner and more modern legislation, without the ‘regulatory gaps’ that hindered investments in the modal, which aligns Brazil with international best practices and ensures the attraction of foreign investments to our airports and airlines,” said the Minister of Infrastructure, Marcelo Sampaio.
TFACs
An important advance of the Voo Simples Law was the updating of the table of Civil Aviation Control Charges (TFAC) with the rationalization of the amounts to be paid. This change brought greater proportionality to the fees, which will be paid according to the complexity of the service.
The reduction in the collection of the TFACs – from 342 to 25 taxable events – also promotes the elimination of barriers to new markets, such as the ballooning market, where the fee was reduced from approximately R$ 900,000 to R$ 20,000. The notary fees were eliminated with the new table and the simulator qualification fee went from R$ 13 thousand to R$ 150.
Fees
With the measure, ANAC now has more regulatory power with regard to the creation and abolition of airport fees for infrastructure use paid by airlines and passengers. It will be mandatory for airlines to inform the Agency of the prices charged, which will be communicated according to the regulations, at ANAC’s discretion.
The project also allows for the reduction of distortions among airport concessionaires, with the extinction of the collection of monthly contributions (about R$ 500 million per year) that used to burden cargo and passenger transportation activities. This measure makes it possible to reduce prices for the end user, contributing to the development of the airline sector.
