ANAC modernizes authorization for landing and overflying of foreign aircraft in the country
The National Civil Aviation Agency (ANAC) approved on August 28th, one more delivery of the Voo Simples Program, created to reduce bureaucracy and simplify procedures in Brazilian aviation. Now it was the turn of modernizing the release of the ANAC Flight Authorization (AVANAC), which is granted to foreign civil aircraft that perform unpaid transportation in the country and to foreign air taxi companies.
In partnership with the Federal Revenue Service, which issues the Temporary Admission Concession Term (TECAT), the modernization of the procedure for communicating the landing or overflying of foreign aircraft and requesting their stay in Brazilian territory was carried out with the objective of increasing the quality and speed of the authorization process. Now, the application and authorization (AVANAC) are automatic and processed online.
Previously, the applicant needed to request via the electronic system (SEI) and attach a copy of the required documents, which were analyzed by a technical team from ANAC regarding applicability and validity. After TECAT’s registration with the Federal Revenue Service, the authorization took effect for the period defined in the process. However, in case of new requests for the same aircraft and pilot, the whole process had to be performed again.
Now, with the automation of the communication of landing or overflight of foreign aircraft, the documents submitted and their link to the pilot and the aircraft are recorded in the system and no longer need to be resubmitted with each request. The methodology has not changed for new requests (first time), but if the pilot and aircraft are the same, and their documents are valid, the system will complete the request automatically. Thus, ANAC’s internal analysis began to focus on documents that had lost validity or that had not yet been verified, which made it possible to reduce the time to issue the authorization.
Revocation of Decree N. 97.464
In conjunction with the modernization of AVANAC, ANAC Resolution N. 178, of December 21, 2010, was updated due to the revocation of Decree N. 97.464/2010, which provided on the procedures for entry into Brazil and overflight of the territory by foreign civil aircraft that were not in regular international air service. Besides the removal of references to the repealed Decree, replaced by the legal provision of the Brazilian Aeronautical Code (Law N. 7.565/1986), Resolution N. 178 underwent other textual improvements to make its applicability clearer, update references to documents from the IRS and the ANAC portal, among other changes that did not affect the content of the rule.
