Seeds and Seedlings
Imports of seeds and seedlings must comply with Law 10,711, dated August 5, 2003, with the Appendix of Decree no. 5,153, dated July 23, 2004, that regulates this law, and with Normative Instruction 25, dated June 27, 2017. In accordance with the regulations, all material for plant propagation is deemed a seed or seedling for legal purposes. The importation of any quantity of seeds or seedlings must be authorized by the Ministry of Agriculture, Livestock and Food Supply upon request of the interested party.

Bear in mind that imports of material for propagation for research must comply with Normative Instruction 52, dated December 1, 2016.
Checking the CITES list
To check the CITES (Convention on International Trade in Endangered Species of Wild Fauna and Flora) list, please click here. The lists have been published by the D.O.U. (Official Gazette of the Federal Executive) no. 48, SECTION 1, pages 54 to 73, dated March 10, 2017, with the list of FLORA species beginning on page 70.
Fertilizers
For importing fertilizers, inoculants and correctives, the International Agricultural Surveillance System (Vigiagro) follows the rules established in annex XLII of the Vigiagro Manual (IN MAPA No. 39/2017), published on 12/01/2017.
Agricultural chemicals
The quality and the effectiveness of pesticides should be maintained for both domestic and overseas markets. Since the use of this product may pose risks to human health and to the environment, the International Agricultural Surveillance System (VIGIAGRO) establishes standards for the importing of pesticides, components and the like.
Every establishment intended for the production and importation of pesticides, components and the like should check the quality of the production process. Furthermore, the individual or corporation responsible for the importation should be responsible for the disposal of the empty packages of the imported products, whether recycling (if possible), reusing and even rendering the packages unusable.
1. Documents Required
a) Application for the Inspection of Agricultural Products (FORM V);
b) Original copy of the Application for the Import of Pesticide, Technical Products and Similar Products, approved by SEDESA/DT in the State of Brazil having jurisdiction over the importing company;
c) Customs Documents for the Product [Import Permit (LI) or Simplified Import Permit (LSI)];
d) Copy of the tax invoice (nota fiscal);
e) Copy of the invoice;
f) Copy of the Bill of Lading or Cargo Manifest;
g) Custody Form.
2. Procedures
a) After the document check, the Federal Agricultural Inspector (FFA) will inspect the consignment and check the label and seal. If the consignment is compliant with the authorization granted, the inspector will electronically approve the Import Permit, entering the number of the Inspection Form and the number and date of the Import Permit issued by SEDESA/DT of that State in the field headed "DIAGNOSIS TEXT";
b) SVA/UVAGRO (Agriculture Surveillance Units) that do not have access to the SISCOMEX system shall make a formal request for approval of the Import Permit to another SVA/UVAGRO (Agriculture Surveillance Unit) within the same state and which is linked to SERPRO, by attaching the Inspection Form authorizing the dispatch;
c) In the event of portioning of imports, the form for the control of imports shall be printed on the back of the Application for the Import of Pesticides, Technical Products and Similar Products, forming a single document;
d) If the Ministry of Agriculture, Livestock and Food Supply requests a remark for the customs clearance of components of pesticides, the interested party shall submit a formal remark by SEDESA/DT in the State of Brazil having jurisdiction over the importing company;
e) If there is a discrepancy in the information, or if the required document has not been presented, the Import Permit shall be placed in a further requirements status or shall be denied, and the reasons for such demand or denial shall be recorded in the field DIAGNOSIS TEXT;
f) In the event of a denial, an Inspection Document shall be issued to prohibit the dispatch. This event shall be immediately communicated to the Technical Department of SFA for further actions to be taken;
g) There will be no handling or sampling at the points of entry of the goods. The samples of pesticides, technical products and similar products, whenever necessary, are taken in the importing establishments by the technical department of SFA in the States;
h) Since reinspection is not mandatory for the import of Pesticides, Technical Products and Similar Products, it is not necessary to issue a Custody Form. This mechanism shall only be applied in special situations to comply with the guidelines given by SEDESA/DT-UF;
i) When releasing the consignment, three (3) copies of the Control of Imported Product Movements (CTPI) (Normative Instruction 25/2003) shall be issued as follows:
First Copy: the first copy shall accompany the cargo to its final destination, and shall be filed and kept at the disposal of the inspection authority, and will be presented whenever requested;
Second Copy: the second copy shall be sent to SEDESA/DT (in the State) for the appropriate actions to be taken; and
Third Copy: the third copy is used for control in the issuing unit.
